SpaceX Faces Labor Complaint Over Alleged Unlawful Firing of Critical Employees
SpaceX has been charged with forcibly terminating eight employees for voicing disapproval of its multibillionaire CEO, Elon Musk.
SpaceX, the aerospace company founded by Elon Musk, is facing allegations of unlawfully terminating eight workers who were openly critical of the company's CEO. The complaint, filed by a US labor agency, claims that the employees, who raised workplace concerns in an open letter to the firm's executives in 2022, were fired in violation of federal labor laws protecting collective advocacy for improved working conditions.
According to Reuters, the open letter referred to Elon Musk as a "distraction and embarrassment." The National Labor Relations Board (NLRB) accuses SpaceX of violating the rights of the workers, who were involved in the open letter, and claims that they were interrogated before being discharged.
The BBC has sought comment from SpaceX regarding the allegations.
Lawyers representing one of the former employees, Deborah Lawrence, have reportedly criticized SpaceX for fostering a "toxic culture" where harassment is allegedly tolerated. In a statement shared with Reuters, Ms. Lawrence emphasized that the open letter was written out of concern for the company's mission and its people.
The NLRB's general counsel has brought the case against SpaceX, and if a settlement is not reached, it will proceed to an administrative judge. The judge's decision can be appealed to the NLRB board and further to a federal appeals court. A hearing is scheduled for March 5.
If the NLRB determines that the firings violated labor laws, it has the authority to order reinstatement and back pay for the terminated workers.
This is not the first time that companies associated with Elon Musk have faced allegations of violating employees' rights. In October, the NLRB accused Musk's tunnel construction company, formerly known as The Boring Company, of illegally firing an employee over tweets challenging the company's return-to-office policy.
Tesla, another company led by Elon Musk, has also faced NLRB complaints, including allegations of race discrimination at its factories. Tesla has maintained that it does not tolerate discrimination.
In August, the US Department of Justice sued SpaceX, alleging discrimination against refugees and asylum seekers in its hiring practices. Elon Musk responded on Twitter, stating that US law requires at least a green card for employment at SpaceX due to the classification of rockets as advanced weapons technology.
